An Act to dissolve the marriage

of John Diston Powles with Louisa
his wife and to enable him to marry
again and for other purposes therein

mentioned ( 6th July 1815 )

Humbly Sheweth and Complaineth unto Your Most Excellent Majesty your true and
faithful subject John Diston Powles late of Kennington Lane in the Parish of Saint
Mary Lambeth in the County of Surrey but now of the Parish of Saint John's
Hackney in the County of Middlesex Merchant. That on or about the Fifteenth Day of
February in the Year One thousand eight hundred and eight your said subject was
married to Louisa his wife then Louisa Chambers Spinster youngest Daughter of
John Chambers of Lowestofte in the County of Suffolk Esquire. That your said
subject and the said Louisa Powles his Wife lived and cohabited together as
Husband and Wife from the time of their said Marriage until the Month of June One
thousand eight hundred and fourteen and have issue of such Marriage.

 

That in the said Month of June One thousand eight hundred and fourteen your said
subject discovered that the said Louisa Powles his said Wife had entered into and
carried on an unlawful Familiarity and Criminal Conversation with Nicholas Robert
Le Mercier of Kennington Lane aforesaid That your said Subject in Trinity Term in
the said Year One thousand eight hundred and fourteen brought this Action at Law
in the Court of King's Bench at Westminster against the said Nicholas Robert Le
Mercier for such Criminal Conversation which Action was tried at the Surrey Assizes
in the same Year and your said subject obtained judement in the same Action for
One thousand Pounds Damages besides Costs of Suit. That your said subject
exhibited a Libel in the Arrears Court of Canterbury against the said Louisa Powles
and on the Fifteenth Day of April One thousand eight hundred and fifteen obtained
against her in the said Court a Definitive Sentence of Divorce from Bed and Board
and mutual Cohabitation for Adultery committed by her with the said Nicholas
Robert Le Mercier. That the said Louisa Powles hath by her Adulterous Behaviour
dissolved the Bond of Marriage on her part and that your said subject stands
deprived of the Comforts of Matrimony and may be liable to have a spurious Issue
imposed on him unless the said Marriage be declared void and annulled by
Authority of Parliament May it therefore please Your Majesty ( out of Your Princely
Goodness and in Compassion to your said Subject's Misfortune and Calamity ) that
it may be Enacted And be it Enacted by the King's Most Excellent Majesty by and
with the Advice and consent of the Lords Spiritual and Temporal and Commons in
this present Parliament Assembled and by the Authority of the same That the said
Bond of Marriage between the said John piston Powles and Louisa Powles being
violated and broken by the manifest and open Adultery of the said Louisa Powles as
aforesaid be and the same is hereby from henceforth wholly annulled dissolved
vacated and made void to all Constructions Intents and Purposes whatsoever and
that it shall and may be lawful to and for the said John piston Pow/es at any time or
times hereafter to contract Matrimony and to marry as well in the Lifetime of the said
Louisa Pow/es as if she were actually dead as after her Decease with any other
Woman or Women with whom he might lawfully marry in case the said Louisa
Pow/es was not living and that such Matrimony when duly had and celebrated shall
be a good and just and lawful Marriage and Marriages and so shall be adjudged
deemed and taken to all Incents Effects Constructions and Purposes whatsoever
and that all and every the Child or Children born in such Matrimony shall be deemed
adjudged and taken to be born in lawful wedlock and shall be legitimate and
inheritable to the Manors Messuages Lands Tenements and Hereditaments of the
said John piston Powles and to all other Lands Tenements and Hereditaments of
from and by the Father Mother and other Ancestors and Relations in life Manner
and Form as any other Child or Children born in lawful Matrimony should could or
might be inheritable unto according to the Laws and Course of Inheritance used in
this Realm or any of His Majesty's Dominions thereunto belonging and shall and
may have and enjoy all Personal Estates Privileges Pre-eminencies Benefits and
Advantages Claims and Demands whatsoever in as full ample and beneficial a
manner as any other Child or Children born in lawful Wedlock may have or claim by
the Laws and Customs of this Realm or any of His Majesty's Dominions thereunto
belonging And be it further Enacted That the said John piston Powles shall be
entitled to be Tenant by the Courtesy of the Lands and Inheritance of such Wife or
Wives as he shall or may hereafter marry and that such Wife or Wives as he shall
or may so hereafter marry shall ( unless barred by Jointure or otherwise ) be entitled
to power Freebench and Thirds at Common Law by Custom or otherwise of and in
the Messuages Lands Tenements and Hereditaments whereof the said John piston
Powles shall be seised of such Estate whereof she or they shall be dowable as any
other Husband or Wife respectively may or might have claim or enjoy and that the
Child or Children born in such Marriage or Marriages shall and may derive and
make Title by Descent or otherwise to and from any of his her or their Ancestors or
Collatoral Relations as any other Child or Children born in lawful wedlock may do
any Law Statute Restraint Prohibition Ordinance Canon Constitution Prescription
Usage or Custom had made used or exercised to the contrary in any wise
notwithstanding And be it further Enacted and Declared that the said Louisa shall/
be and she is hereby barred and excluded of and from all Dower Freebench and
Thirds at the Common Law by Custom or otherwise and from all other Estates
Rights Titles Claims and Demands of in to or out of any Manors Messuages Lands
Tenements or Hereditaments whereof or whereunto the said John piston Powles
now is or since his said Marriage hath been or at any time hereafter shall or may be
seised or entitled for any Estate of Inheritance and of and from all Rights Titles
Claims and Demands whatsoever in to or out of all or any the Goods Chattels
Personal Estate and Effects whatsoever which the said John piston Powles now is
or since this said Marriage hath been possessed of or entitled to either in
Possession or Remainder or which he the said John Diston Powles shall at any time
or times hereafter become possessed of or entitled unto and of and to all and every
the Right Title Privilege Pre-.eminence Benefit and Advantage Claim and Demand
